Remembering A.G. Noorani

Life and Legal Career: Abdul Ghafoor Majeed Noorani was born on 16 September 1930 in Bombay and passed away at his home in Mumbai on 29 August 2024, at the age of 93. He obtained his law degree from Government Law College, Mumbai. He began practising at the Bombay High Court in the 1950s and later appeared before the Supreme Court. One of the defining moments of his legal career came when joined Sheikh Abdullah’s defence team. This ignited his lifelong engagement with the Kashmir question.

Scholarly Contributions as an Independent Scholar: Noorani’s significance lies not merely in his being a lawyer, but in his being a completely independent scholar. He held no tenured professorship, received no institutional funding, and enjoyed no think-tank patronage — yet he produced an irreplaceable body of work across multiple fields.

Kashmir studies was his core domain. The Kashmir Dispute, 1947–2012 (two volumes, 2013) systematically maps the legal and political contours of the question using archival material. Article 370: A Constitutional History of Jammu and Kashmir (2011) offers a deep analysis of the formulation and evolution of this special provision; though the narrative is neutral, his implicit support for its retention can be reasonably inferred. He also wrote The Destruction of Hyderabad (2014), which uses solid historical evidence to present an event marginalised in mainstream narratives.

Political trials in colonial India formed another major area. The Trial of Bhagat Singh: Politics of Justice (2005) uses a lawyer’s insight to show how the trial of Bhagat Singh and his comrades became a judicial murder. Indian Political Trials, 1775–1947 (2006) covers a wide range of cases, from Bahadur Shah Zafar to the Indian National Army, placing colonial legal history within the framework of political power.

On secularism and right-wing politics, Noorani wrote The RSS: A Menace to the Nation (2019), Savarkar and Hindutva (2002), and The BJP and the RSS: A Division of Labour (2000). These works made him one of the sharpest critics of Hindu nationalism. The RSS: A Menace to the Nation traces the organisation’s history from its founding in 1925 to 2018, arguing that the RSS threatens not only communal harmony but democratic governance itself.

Scholarly Significance: Noorani’s intellectual path raises a fundamental question: what is the work of an independent scholar? At a time when institutional dependence is increasingly common in academia, Noorani — who never held public office or institutional funding — produced knowledge more durable and credible than that of many institutionally embedded scholars. His writing spanned constitutional law, history, international relations, and political commentary, yet never wavered in its commitment to secularism and constitutional values.
